Yes, but that was before GOP's decision to repeal mandate. Now that the mandate--and hence, the "tax"--is gone, it's virtually certain Roberts would vote to invalidate the law. He already said Congress didn't have authority under the Commerce clause.

A reminder to Republicans: Even John Roberts bought into the patently absurd, made up action/no action distinction used in attempting to overturn the ACA ....and John Roberts killed thousands of Americans by going along with gutting the Medicaid expansion on nonsensical grounds.
