    As young gov’t lawyer in criminal case, court of appeals was moving so quickly opposing counsel was in bathroom when case was called. I got up to explain but they had me argue tho I was appellee. Appellant returned & had to respond to argument he’d mostly missed. I got rebuttal.

    Newly confirmed Judge Eric Komitee is seeking law clerks. He’s a great guy with an enormous breadth of experience and would be a great mentor. Highly recommended.

    This is exactly right. Far better than if a judge raises a concern for the first time at conference after argument.

    According to some local musicians who attended that show, the Who rented gear from a local music shop. I think it’s safe to say that the Who forfeited their damage deposit.

    In 1931, my grandfather John Elwood, with a high-school education & approx. 8 5/6 fingers in those pre-OSHA days, built the 1st Caterpillar diesel tractor. He kept 2 vehicles beside his house outside Peoria: a VW Beetle & a Cat bulldozer bought w/his employee discount.

    I'm helping a federal prisoner with her immigration case as a pro bono matter. She asked me to send her a copy of her immigration file. Today the prison returned the file because it "contain[ed] personal information (social security numbers)." HER OWN social security number.

    Just returned from whirlwind trip to San Francisco & Denver--about 3 months of travel for me jammed into 4 days. In SFO, I stayed at Hyatt Regency Embarcadero, a perfect artifact to 1970s futurism, straight outta Logan's Run. We have seen the future, and it's exposed concrete!

    I am struck by how often I show up for a circuit court argument & know other counsel there for argument, frequently from DC. For argument in San Francisco next week, 's will be before me--admirably, supervising a student's argument!

    The Supreme Court will today likely fill out its calendar for the 2019-2020 term. There a number of very significant cases the Court could add to the docket. Stay tuned.
