If he didn't fight the lawsuit there'd be no case or controversy for the judge to rule on... but it doesn't really matter because it's all going to blow up as a ridiculous farce like every other Trump election lawsuit.

hey man! i haven't seen the brief yet but if he's asking the judge to dismiss the suit it means Pence, or the Office of the VP, is arguing that the suit is baseless and stupid and they'd like the judge to reject it.
