They lack standing. They cannot claim an injury in fact different from the general population and the Court lacks authority to order a remedy.

The plaintiffs in the most recent ACA lawsuit lack standing. Yet they “won” in front of a Republican masquerading as a judge in Texas, then in front of the Republicans masquerading as judges on the 5th Circuit, and now their lawsuit is pending at the SC. Put nothing past them.
