Thieves aren't dumb (and the people doing this sort of shoplifting aren't always mentally ill). They are often smart people who respond to incentives and costs. If there is ultimately no penalty, they understand that. They don't need to know boudin's name, just his policies.

I wince a bit at "often" but I don't have the data to counter. I don't disagree with punishment, but where's the data to say what is effective? B/c what I've seen incarceration is not, and it's a drain on resources to prosecute these types of crimes. So what do you do?

I think you need to enforce the law, arrest the individuals, enact punishment, which may be rehabilitative in form, and work on prevention. We're just never going to incarcerate or otherwise deter our way out of these kinds of crimes, unless you want to enact chopping hands.
