Quasi-property right, yes. Even more so if state law recognizes the right of publicity (aka personality rights).

Freedom from biometric (or any other type of ) surveillance should be an inalienable right... as fundamental as Life, Liberty, and the Pursuit of Happiness...

It needs to be framed as a positive, though. As in, "the right to privacy."

In U.S. health IT, the focus has become the rights of patients to access their data (only really for clinical medical record data - not other kinds of health data). But right of access does not solve even very basic issues related to consent, control over re-uses/exchange, etc.

This is running on the flawed assumption that biometric data is simply there, and someone should have a right to it. It doesn’t exist until it is created, and regulation should target the creation to stop it there.

#property one is fundamentally misconceived and dangerous. We may need to develop the law (& rights); we definitely need to improve#enforcement of &#respect for them both, but the fights we are having are not new - though the tech precipitating them may be.
