Honest question because I see these kinds of claims being made occasionally and, from the outside, the situations can often be explained without discrimination. Logic usually goes: 1. Boss didn't do it my way 2. I know better than boss ∴ Boss must be bigoted How do you know?

Corroborating evidence. (boss has a "Women Suc!" bumper sticker). But that's irrelevant. Discrimination laws violate freedom of association, rob you of valuable information (racists now go under cover), and create liability incentive for non-discriminators to discriminate.

Anybody can put a bumper sticker on your car! I get the objective of workplace discrimination laws but I do think the outcome in practice might be as you say. Do employers view the risk of a discrimination case as a reason not to hire a minority they otherwise would have hired?
