I’m getting flashbacks to the summer, when people said impeachment was necessary even if it wouldn’t lead to removal because we had to show there was “accountability” for Trump’s actions. I would ask how impeachment was accountability; people looked at me like I had five heads.

To be clear, *I* do not think impeachment has had or will have large effects, despite all the noise. I don’t think it leaves Trump more inclined to do any particular thing after acquittal. I don’t buy any of the GOP slippery slope arguments. I don’t regret that Dems impeached.

Hey, if you’re Kantian, and many flavors of virtue ethicists, you gotta do the right thing even if the consequences are worse.

Admittedly Kant never made any sense to me in college.

I don’t think this is the right framing. The worst consequence would be no impeachment and no accountability at all. The fact that impeachment without conviction is the second worst outcome doesn’t mean we should ignore the negative consequences.

The alternative is susceptible to a parallel critique: “you thought it was so serious, but didn’t even try to assert the primary remedy afforded to Congress?”

Because the damage would have been even worse in all of these respects had the president not even been impeached, had Congress done nothing. Much worse. Also, expecting the system to fail is a great way to ensure that it always does.

The correct answer is that failure to convict does not embolden future misdeeds, but rather clarifies the choices voters have before them in November, to remove the Senators who did not vote to convict, and especially those who did not even vote for witnesses.

Because what strengthens him is a lack of consequences and no method for holding him accountable. Refusing to try him at all brings the same outcome as refusing to hear witnesses, and for the same reason.
-
So we still have an unaccountable president, but we have made the GOP go to the mats defending him. If we hadn't, they would go into November feeling even more invincible, and any talk of Trump's corruption would be answered by "Then why wasn't he impeached?"
