Incredible Fed Soc brain here from Sixth Circuit judge John K. Bush, who reasons that an anti-choice law that leads to a *100 percent* decrease in abortions might not be a "substantial obstacle" to abortion because "maybe the law changed their minds" https://www.opn.ca6.uscourts.gov/opinions.pdf/21a0175p-06.pdf …pic.twitter.com/vIc5rgLpUx

This is a tidy example of how the conservative legal movement chips away at abortion access over time: A majority opinion upholding an anti-choice law, coupled with a concurrence that lays the groundwork to uphold even more anti-choice laws in the futurepic.twitter.com/FTasNJDps6

[me, very smart, on trial for armed robbery, representing myself] your honor, I'm not sure why we're assuming the victim handed over her wallet because I held a gun to her head when it's entirely possible that I simply persuaded her it was the right thing to do

Looks like my very smart defense convinced at least one sports ball caricature juror at my trial, big daypic.twitter.com/QLBZfYnLax

Consideration of anything other than the intent of the law and the bare statistical outcome is obviously completely impossible Like there’s no conceivable way that we could ever investigate any evidence in between the law and its outcome to find out the reasons for the effect 🤪

This guy would be a government official in Gilead, giving women to those in power to impregnate. But that would be okay because it would be the law and they’d willingly abide by the law (it changed their minds about losing their freedom & personal autonomy). Give me a break!

'can we really say it was a substantial obstacle to get an abortion if, after we established this obstacle, literally no one got an abortion? who can say?'

This reminds me of how sometimes, fake clinics post things like, "There's no rush to schedule an abortion, because a lot of pregnancies end up being miscarriages, anyway. So you probably don't even need that appointment." I feel like that was in the draft of this opinion.

But I was told by Orin Kerr that the Fed Soc is not responsible for stuff like this. No matter what programs and speakers they sponsor, to the point that this is recognized as ripe for (well received) parody.
