3/ Anyway in all likelihood this will be sorted out by the lawsuits to come. I'd much rather have it be sorted out by talking openly and honestly about this stuff but that seems to be the trajectory we're set on, thanks in large part to institutional cowardice.
And thankfully, any case will have to go more or less directly to SCOTUS now that "transgender status" falls under the CRA
