Essentially they can add on the second degree as a moonshot, prosecute "if not second then at least third degree," and claim a win by bagging what was on the original warrant.

No problem. It is kinda counterintuitive, and it's true the Dems are insufficiently concerned about the riots, but I think they're at least gonna try to get a scalp here.
