Not sure how that works. If they charge him with second degree I don’t think they can also charge him w/ third degree, since one charge is intentional and the other not, those are mutually exclusive. Any lesser charges would not satiate the mob, the sentence would not be adequate

Essentially they can add on the second degree as a moonshot, prosecute "if not second then at least third degree," and claim a win by bagging what was on the original warrant.
