The jury can find him guilty of a lesser included charge, if that helps at all.

Not sure how that works. If they charge him with second degree I don’t think they can also charge him w/ third degree, since one charge is intentional and the other not, those are mutually exclusive. Any lesser charges would not satiate the mob, the sentence would not be adequate
