The more we encounter free speech challenges on social media, the more I think big tech shouldn’t try to reinvent the wheel. Why not apply general First Amendment principles to their own marketplace of ideas?

Here’s the issue with that, in my view: the social media “marketplace” is very different from the real-space marketplace of ideas, and has a different context, which I think is what the companies are trying to understand.

I think you can begin with the 1A framework and tweak to deal with the peculiarities of the specific platforms. But we’re spending a lot of time arguing about speech principles the law settled long ago.

I think the issue is that these companies need to affirm, “we are private companies, we are not public utilities, if you don’t like it, well"
