  9. Judge: September, then. Sept 14? Time is waived? Yes. So I will speak to you, I'm not going to say in person. Stay healthy, and fly the flags on the 4th. Of July. Story later.

  10. Judge: Maybe we can even schedule a... trial! Defense lawyer: We're all trying to figure out what that will be possible. AUSA: Let's exclude time under Speedy Trial Act. Defense lawyer: We understand there's a BOP lockdown given the other situation []

  11. Only the US can send a drive into the MDC, not the defense lawyer. So US will sent one in - with the contents of 3 cell phones. "How much is on them?" Judge Feuerstein asks. AUSA: It seems like a lot if you look it by bytes, but -- Judge: Let's meet in 2 months.

  13. COURTROOM CONFIDENTIAL: Amid COVID, In Case Kooda B Kentea McKenzie's Lawyer Lisa Scolari Withdraws, Citing A Secret Conflict of Interest that existed even at the time he pled guilty; sentencing by Judge Engelmayer to be postponed

  14. The strange thing here is that the lawyer who appeared before Judge Engelmayer specifically to take over for Scolari for a June 24 sentencing then said he doesn't feel comfortable coming to the court even in July. Judge Engelmayer seemed surprised.

  15. Yes - she withdrew, citing a pre-existing conflict of interest that she will not publicly disclose. Inner City Press will work on this. Sentencing won't be June 24; date unclear. New lawyer says he doesn't want to come to court due to COVID19 risks. Story later.

  18. Judge Engelmayer: If it is the case that the information you would share would case Mr. McKenzie in a bad light, I could disregard it. When will you send the letter? End of the day Friday. It will be emailed - "We can take care of submitting it under seal."

  19. Judge Engelmayer does not order the filing of a public letter, but one "ex parte" with him, in camera so the public will never see. How does the presumptive public nature of Federal criminal cases apply to this? Scolari: I will take that under consideration.

  20. Judge Engelmayer: I expect to grant your request since you say unwaivable conflict. However, this relates to some other legal representation of yours. Which predates this one. At some point some person may claim you've worked under a conflict. I want to know more.

  21. Filings in Federal court cases, particularly criminal cases, are presumptively public. Judge Engelmayer just said he thinks this is entitled to sealed treatment. But he did not, it seems, give any indication of why. "An issue arose in March, letter of April 6."
