BIG WIN FOR INDIAN COUNTRY: The 5th Circuit Court of Appeals just issued its decision in the Indian Child Welfare Act case. By unanimous vote, the court upheld the constitutionality of the law designed to prevent Indian children from being taken from their communities.

The 5th Circuit Court of Appeals overturned a federal judge who struck down the Indian Child Welfare Act as illegal, based on the "race" of Indian children. The 5th Circuit, applying long-standing principles, confirmed that ICWA is instead based on a "political" classification.
