my argument in support is that landlord background checks are ineffective when everyone does them. you already can't evict people for committing an unrelated crime. so most Oakland residents with a criminal record will stay in the same place, or secretly sublet.

so, this is a bad equilibrium. it isn't rational for a single landlord to be the only one who accepts ex-cons. but this isn't reducing the number of ex-cons in oakland, it's just preventing them from moving around, which increases housing inefficiency.
