Court rules that chalking tires to track parking infractions violates Constitution
The Sixth US Circuit Court of Appeals ruled that chalking tires to monitor how long a car is parked in a time-restricted space violates the Fourth Amendment, which protects people against unreasonable searches of their property. The court covers Michigan, Ohio, Kentucky and Tennessee.

Parking enforcers will at times use "chalking" to determine whether someone has been parked in a spot for too long. Someone challenged the constitutionality of the practice, and the U.S. Court of Appeals for the 6th Circuit said the case can continue: http://www.opn.ca6.uscourts.gov/opinions.pdf/19a0076p-06.pdf …

A lawyer representing a woman fed up with parking tickets successfully argued to a federal court that marking tires with chalk is similar to police secretly putting a GPS device on a vehicle without a proper warrant.http://apne.ws/IGsQVfp

”The City does not demonstrate, in law or logic, that the need to deter drivers from exceeding the time permitted for parking—before they have even done so—is sufficient to justify a warrantless search under the community caretaker rationale.”

”The district court granted the City’s motion, finding that, while chalking may have constituted a search under the Fourth Amendment, the search was reasonable. Because we chalk this practice up to a regulatory exercise, rather than a community-caretaking function, we REVERSE.”

I like Judge Donald, so I'll forgive the pun. (From today's opinion on the chalking of tires and the Fourth Amendment: http://www.opn.ca6.uscourts.gov/opinions.pdf/19a0076p-06.pdf ….)pic.twitter.com/x6KnC7I8jL

http://www.opn.ca6.uscourts.gov/opinions.pdf/19a0076p-06.pdf … This is why judges matter. Judge Donald was public defender back in the day & clearly took that experience with her to the bench. We're all products of our environment. When gov't advocates become judges, you get Article III co-counsel. cc:

In a blow to the extortionate and regressive government practice of ticketing vehicles parked "too long" in one place, the U.S. Court of Appeals has ruled that "chalking" cars is unconstitutional. The 6th District ruling is binding in MI, OH, KY, and TN: http://www.opn.ca6.uscourts.gov/opinions.pdf/19a0076p-06.pdf …

Kudos to Alison Taylor! I have heard some rational arguments against charging the public for use of public parking spaces and this is a big step in that direction.https://twitter.com/NPR/status/1120713941926047744 …

I call bullshit: "Physically marking a tire without a warrant is a violation of the Fourth Amendment––[which] protects people from unreasonable searches and seizures––a federal appeals court ruled."https://www.npr.org/2019/04/23/716248823/court-says-using-chalk-on-tires-for-parking-enforcement-violates-constitution …

Maybe "Alison Taylor, a Michigan woman whom the court describes as a 'frequent recipient of parking tickets'" should have just parked her car legally...

Yes, tire chalking is a trespass, but municipalities may adopt reasonable rules for parking on public streets. The 6th Circuit failed to recognize that element of this issue. If you want to park on the public street, you are agreeing to get chalked. http://www.opn.ca6.uscourts.gov/opinions.pdf/19a0076p-06.pdf …

Fascinating CA6 opinion today holding that chalking a tire for parking enforcement -- to see if the car had been there a while in violation of parking rules -- violates the 4th Amendment. Not sure where I come out on it, but fun issue. Here's a thread. http://www.opn.ca6.uscourts.gov/opinions.pdf/19a0076p-06.pdf …

The court first reasons that the chalking is a Jones trespass, which the court, without analysis, says is determined by a common law trespass test as interpreted by the Restatement 2nd of Torts.pic.twitter.com/5tvejEpUvF

The court then says the trespass was done "to obtain information," as required by Jones, b/c the purpose of chalking is to find out what cars haven't been moved.pic.twitter.com/FVlGSfTYK6

Having found a Jones trespass, the court then says the search was unreasonable. First, the automobile exception doesn't apply b/c there was no probable cause.pic.twitter.com/gbkXmgibpu

Third, there is no general reasonableness based on the government need to maintain efficient and orderly parking. B/c no exception to the warrant requirement applies, the chalking violated the 4th Amendment.pic.twitter.com/QXdvoHdXNn
