paramilitary is easy. you don't even have to do anything except march around and pretend to be a soldier in some regard. 'insurgent' is an actual combat thing.

They were in fact a little suspicious which is why the cops checked in and dispersed them. They weren’t a fascist militia preparing to engage in hardcore street fighting. At least not based on the current evidence.
And this isn’t just some fucking abstract principle, this is basic totalitarian shit: anyone organizing in a group for any reason falls under suspicion if you get paranoid enough. “Oh sure you don’t seem to have guns but bike locks are now a lethal weapon, into jail with you!”
