    Hey : 1. Circuits don’t “grant appeals” in cases like this one; they *have* to hear them. 2. You haven’t sought an injunction pending appeal (circuits can’t issue “TROs”); and 3. Your one case “in already” is a nothing-burger. But thanks for the laughs!

    Hey and , do you know how a case GETS to the Supreme Court? One side has to appeal a final opinion they disagree with. As I said, Third Circuit has granted our appeal, and we already have one case from PA pending before SCOTUS. Thanks Ari for having me!

    's 2000 intervention in Florida was problematic on a number of levels, but it was in one state where the final margin was 537 votes. Anyone who thinks the Court is going to intervene in 3+ states with five-digit margins is selling you something (like their campaign debt).

    This is a really important point: Once PA certifies, the Trump lawsuit would become moot regardless of whether the (not-yet-filed) appeal is still pending in the Third Circuit or — because all the Elite Strike Force asked for is a remedy that would then be impossible.

    A quick note about the PA lawsuit, now that we've all absorbed the opinion last night. The *only* relief that Trump asked for was to prevent certification. You can see it here. So this case winks out of existence the second PA certifies the vote.

    And as reminds me, it’s not even *your* case that’s pending before . Your motion to intervene in the Pennsylvania GOP’s (irrelevant) appeal has been pending for two weeks—which is not exactly a good sign that it will be granted.

    The Trump campaign *says* that its strategy is to get the PA case to as fast as possible. But even as it's asked the Third Circuit to expedite its appeal, it *hasn't* asked for an injunction *pending* appeal—a denial of which would be the only way to get to SCOTUS *now*.

    It’s almost like losing disastrously in the district court just so that they could get to faster was *not* actually their plan...

    The president's lawyers have not yet filed their "expedited appeal" to the Third Circuit.

    Another good discussion about and on today. Suggestion, SCOTUS appts should be for 10 years (rotating). That’s longer than any one President and allows for changes in the national attitude.

    And because they lost in the district court, they need more than a stay from the Third Circuit or ; they’d need an injunction pending appeal — which requires an even greater showing to obtain than a stay.

    took no action today on a pair of appeals by the Trump administration and Arkansas arising out of the former's approval of the latter's controversial Medicaid work requirements. No action today means there's a decent chance it will grant them at its Conference on Dec. 4.
