And hard tonal shift: a new filing tonight from the #USWNT players that essentially acts as a rebuttal to Hope Solo's most recent filing against the class action settlement. "Her expected pro rata allocation of the settlement fund is $339,999 after attorneys' fees and costs."
Since preliminary approval, class counsel served the approved class notice and
17 settlement agreement on all class members. Only one member (who has been pursuing
18 her own individual equal pay action against USSF in another jurisdiction) objected and
19 did so on grounds that lack any merit. Specifically, the objector has complained that
20 the notice was inadequate, but this Court has already approved the form and substance
21 of the notice, finding that it “sufficiently inform[ed] the class members” of the terms of
22 the settlement and the opportunity to object. Id. at 5. The objector also complained that
23 she did not yet know the specific amount of money she would receive from the
24 settlement fund, but that information was always going to be provided and she has been
25 informed that her expected pro rata allocation of the settlement fund is $339,999 after
attorneys’ fees and costs.3 In addition, because the objector has separately asserted an
2 EPA claim against USSF, her FLSA EPA claim has been carved out of the release so
3 that she is not releasing that claim here. She thus has no injury or standing to object to
4 USSF paying the claims from a single settlement fund, as allocating some settlement
5 amounts solely to the FLSA claimants would result in a lower recovery to the objector
6 because she is not a member of the FLSA collective action. In any event, Plaintiffs’
7 proposed pro rata allocation of damages from a single fund is the fairest and most
8 reasonable distribution here because the EPA and Title VII damages compensate class
9 members for the same conduct by USSF and the EPA damages period is entirely
10 subsumed within the Title VII damages period.

•	Abby Dahlkemper: Going to have a surgery, will know more after… “She’s going through a tough time, unfortunately, with three consecutive injuries.”  
•	Tierna Davidson, Emily Sonnett, Kelly O'Hara, Lynn Williams: Doing well, expected to be in consideration for January camp call-ups
•	Casey Krueger: did some training with the Red Stars before they were eliminated… “Looking forward to see her in camp too” 
•	Cat Macario: Hoping to see her back in February 
•	Christen Press: Had a slight setback in rehab, probably a little behind Cat Macario’s timeline
