My sources at SCOTUS have leaked an early draft of the dissent in .

    ** SATIRE **
JUSTICE KAGAN, with whom JUSTICE BREYER and JUSTICE SOTOMAYOR join, dissenting.
After considering the argument presented by the majority, the inescapable conclusion is that the court is replacing its “deeply rooted … tradition” of stare decisis with the more ancient tradition of fellat ad aurantiaco rex. See ante, all that shit.
In our role as protectors of Justice and the values of equality and equity enshrined in the Constitution, we cannot stand idly by. We respectfully dissented in Brnovich v. DNC 594 U. S. ____ (2021), but as the great philosopher says, “This aggression shall not stand, man.”
Therefore, our response is quite simply: fuck this shit.

Footnote: TODO: Get a clerk to properly cite this.

[More humor in the comments, including Kagan looking for a copy of the "Anarchist's Cookbook", and her saying, "Fuck Alito in his fallopian tube with a cactus. There are days I want to Thanos Snap this entire court."
  2. A must read re : “the United States amended its Constitution to strengthen its commitment to human liberty in the formation and families and the conduct of family life. This history frames today’s debates about reproductive freedom.”

  3. Justice Alito’s conception of “liberty” in the leaked draft is wrong in pretty much every way you can imagine. Check out this ⁦⁩ piece from my ⁦⁩ colleague David Gans:

This. is already a white Christian Nationalist stronghold. But who cares, right? It's just Mississippi...see where that's gotten us...

  8. 1/ Re-reading the opinion last night, I was struck forcefully by how false and extraneous the argument abt fundamental rights protected by due process being "deeply rooted in this nation's history & tradition" is.

Everyone who loves the preborn and wants justice for them—Pro-life, abolitionist, whatever—must read this amicus brief presented to the Supreme Court during the hearings.

Abortion isn't SAFE. Soon, it will be ILLEGAL. And it will be RARE (committed only in the states that still believe that we're not created equal).

  12. Just thinking how interesting it would be if Philip K. Dick, who died in 1982, were alive today to submit an brief in v. Jackson Women’s Health Organization. Reading this amicus brief brought to mind his 1974 post- short story, “The Pre-persons.”

  13. The parousiastic certainty some have that there shall be no more mourning, wailing or pain after the decision and the old order has passed away is simply breathtaking. I've always said culture warriors were gnostics. I've never felt more sure.

Glad to join with in on how J. Alito's leaked opinion dismisses the gender equality and reliance arguments for abortion rights in Casey and since and treats the costs of pregnancy as invisible.

: Why would making our more like 's abortion laws be bad for ? Is France such a terrible place for women?
