    Kevin was required to see a therapist when he got to the US. She said their sessions would be private. Instead, everything he disclosed was passed to ICE, to be used against him in court.         Under new Trump administration policies, more and more immigrant children are having intimate confessions, early traumas, even half-remembered dreams used against them in court. They’re not allowed to skip these therapy sessions, and everything they say can be filed as evidence.

        Why is this not a HIPAA violation? The government acts as de facto parent to the tens of thousands of kids who come to this country alone or are separated from their relatives at the border each year. As legal guardian, it can ask for records and share them as it sees fit.

        But while it may be legal, groups like the American Psychological Association say the policy is unethical and a profound violation of patient confidentiality. Many of the shelter therapists I talked to had no idea their notes were being used like this. One called it "sickening."

        Not much different than the Gitmo & black site doctors. Once they know it’s happening, and they still go along with it, I have no sympathy for them or any bad consequences they face.

        Unfortunately HIPAA isn’t privately actionable, so you’re dependent on authorities to be willing to press any legal consequences. Which is more challenging when it’s the government itself suborning the activity.
