So... Ubuntu has been going towards ZFS for over four years now without any recourse. If Linux had a leg to stand on, wouldn't they be doing something about it? By now this just a small dog / loud bark thing, right?

The license is the only reason we are grumpy. It's a license specifically designed to be NOT compatible with the kernel license. If the author/owner of that codebase wanted to change this, they could do so tomorrow to resolve all of these issues and everyone would be happy.

That's just a (expensive) war between lawyers. Both sides lacks respect for specific needs of other side, both have their own truth. This virtual (holy) war is here for years. But who really benefits from it?
