LOL, legally or medically. Physicians prescribe medications off-label all the time, including HCQ and they have the legal authority to do so. Physicians have a fiduciary duty to do always do what's in the best interests of their patients.

Often, the FDA-approved indications for a drug are narrow. I think gabapentin is FDA-approved only for seizures and post herpetic neuralgia yet it's used for every pain syndrome under the sun. Medically or legally, patients don't need to be in a trial to use a med off-label.

Having worked in Pain Mgmt, Rheumatology & Orthopaedic Spine surgery I am MORE than aware of that. It’s still a false equivalence.
