No, it’s not. Motive has been a major consideration in defining crimes and, after conviction, determining their appropriate punishment since time immemorial. Hate crimes are no different.

Yup. In fact, terrorism in general is based on motive, namely trust it’s worse to burn a cross, to beat up a person, out to kill someone if the motive is to terrorize.
