He didn't take the training that he was instructed to take. Outside of academia, such a refusal might well result in termination of one's employment. So, yes, he got off easy.

I suspect he got off easy because no harm was found to any of the subjects and he didn't use federal grant funds to do his "study." He could just refuse to take the training, and as long as he doesn't do any human subjects research again he'll be fine.

Of course, he'll have a problem if he ever wants to collaborate with anyone who plans on doing research that requires IRB approval. Basically, he won't be able to do it without doing the training and meeting with the official as required.
