Oliver Wendell Holmes was a dipshit. The law is a morality. It is an imposition of a morality. Either in acquiescence or prohibition, it proclaims things to be good or evil.

thats the dream or rather, the lie of the liberal managerial state, it pretends that citizen's morality has nothing to do with utilitarian "functioning" of society writ large. impartiality is thus an ironic pastiche, even a weapon used to mask liberal moral imposition.
