Unless there is a significant change to US Surveillance law underpinning this, it is hard to see how it could survive a challenge. In that scenario, the role of the Commission lawyer before the CJEU is not an enviable one!

Nearly 1,000 pages in our affidavit and accompanying submissions. Kudos to our legal counsel and team (most not on Twitter). In particular, thanks to & to who has been on this journey with me since 2018.

As we reported previously, the DPC is the bottleneck of GDPR enforcement against Google, Facebook, and other big tech firms for the whole EU. Its failure to act against Google's RTB system has exposed all Europeans to it for 3½ years+.

We are taking the Irish Data Protection Commission to court. For 3½ years it has failed to act on a GDPR complaint against Google’s massive Real-Time Bidding (“RTB”) advertising data breach.

5 years ago (May 2017) I told the Irish Data Protection Commission about the massive "RTB" data breach in online advertising. I and colleagues (the great ) were developing a system to fix it. The DPC engaged with us a little. But it did not act against RTB.

What is especially powerful about the Austrian DSB's decision on is how it turns out all the "legal experts" that are great in commenting on topics, but really bad at reading facts, law and decisions.. 😉 ..amazing how people get paid for this! 💸🤑

As ever, nails it. France used the ePrivacy Directive to sidestep Ireland and directly enforce v Google & Facebook. Meanwhile, the European Commission claims all is well. Read her piece in TechCrunch here

Ireland's Data Protection Commision is clearly under siege - and needs an overhaul of funding, structure and leadership.
