      Couldn't the authorizations and denials still be publicly released, even if not a complete picture? And shouldn't member states not providing info be encouraged to (even if not legal requirement)? EU announcement says this is necessary for transparency - and I agree! pic.twitter.com/eV3vmZUHlg

      To recap, current policy is that before any company in EU exports certain COVID-related medical goods & equipment to non-EU country, must apply to member state for authorization.       I first want to reiterate that I’m not instinctively opposed to the EU policy. Export restrictions on medical goods are a complicated issue, and I believe Commission is grappling in good faith with a genuinely hard problem. 3/

          Export bans combine two impulses: 1) recognition that public interest, rather than ability to pay, should determine distribution of critical goods, and 2) a beggar-thy-neighbor attempt to force costs onto others. The first is good, second is bad, Q is how to better manage 2/

          While there’s no simple answer, I do think one obvious (and relatively easy) piece of this puzzle is that governments should be as transparent as possible in their policy decisions. They should provide clear rationales for why and how they make the decisions they do. 6/

          First, it allows other countries to know how EU member states’ decisions will impact their own supply chains, and plan and act accordingly, as quickly as possible. This could save lives. 8/

          Second, it’s important for developing better shared norms over the (il)legitimacy of various export restrictions. Gov’ts should stand in front of their peers and provide rationale for their decisions, and listen to other gov’t's responses to their policies. 9/

          I don’t think there can or should be binding int’l obligations on these types of questions dealing w public health or nat’l security – nation states have responsibility to their citizens to protect them, and should maintain relatively broad policy space to do so. 10/

          But we do need better means of assessing the legitimacy of such actions, and developing some shared expectations about when such actions are valid vs when they constitute beggar-thy-neighbor protectionism (and thus should be resisted diplomatically/politically). 11/

          The EU created a sample form for states to report their export authorizations, complete with lines to fill in on if authorization was granted, why or why not, and if there was any consultation with other member states. 12/pic.twitter.com/g0LYh8YT5n

          It is Member States that grant/refuse authorisations. They are invited to inform us, but r not legally obliged. Many do, others don‘t - so we do not have a complete pic. From what we see, they honour int‘l solidarity and humanit. needs - auth have e.g. gone to W Balkans + DCs.

          Which is really a shame. Because gov’ts should publicly – indeed proudly! – stand behind their decisions to restrict trade or not, and explain what their rationales are. And if they won’t, we should of course ask why not. 13/

          The EU should bolster its commitment to transparency, and agree to publish the details of member states’ export restrictions. (I favor full transparency, but would settle for anonymizing some commercially sensitive info, if and where necessary.) 16/

          It’s the right thing to do. And ultimately it’s in the EU’s long term interest to shape a global econ order based on int’l cooperation and shared norms, rather than every-country-for-itself nationalism; which is where we may be headed otherwise. 17/17(cc: @alanbeattie, @snlester)
