I mean, more or less. My educated (I'm an IT guy at a company that deals with PHI, not a lawyer) guess would be that they developed a procedure for sending the data a few years ago and had it vetted by their lawyers... so to the change the procedure they'd need to do it again

SSL/TLS is definitely up to the task most of the time, but there's an extra "feel good" factor that comes with an encrypted DVD that goes with a courier... there's only one copy, and almost no possibility of eavesdropping in transit
