do you mean the red pre-order box? Pretty sure they can. They're essentially saying that you're joining a queue and you'll get it when your order reaches the front of the queue. However, they also must ensure that pre-orders are filled first and that the wait is reasonable.

You're guaranteed to get it, just not on the launch day because (I assume) they don't know how many units they're getting. It's a small gamble on the consumer's part that JB will get extra stock before other places, but it's not a scam or anything.

it'd be a more fair if they took a deposit (like most normal retailers) and then billed you for the full amount before shipping (and if your transaction declines, then the next person in the queue steps up). But that has issues too.

Great insight. Interestingly, I've pre-ordered stuff from the UK and then 2 days after release day, it's been cancelled with no advice to me. It's frustrating as a consumer (this was a Ltd edition buy) because it's a good faith thing, and loyalty stops me buying elsewhere.
