Judge: the legislation as interpreted by Strasbourg clearly does require two proportionality exercises, the first to decide whether it meets a "pressing social need" and then to ask whether what will be achieved by #spycops is proportionate to the intrusion involved.
Judge: The HMIC report questions whether these operations were necessary at all.
Perry: We rely on the SOCA report.
It is worth noting that SOCA report was secret and internal, and meant to feed into HMIC findings on #spycops, so I think HMIC must trump SOCA on this.
