The judge gave confidence to the parties that he would take a decision well before the April 30 extension deadline that Telegram got from the investors to launch the network / grams.

The judge asked what would happen to TON if Telegram team would “take investor money, leave for an island and give up on TON” and heard confident statements that community would pick up and successfully develop the project further.

Telegram/Skadden argued that grams could be a security during the token sale, but could easily become a typical utility shortly after launch and there are a lot of prerequisites for that.

The judge quoted a “TON can be launched with a 5 second notice” statement from TON Community Foundation amicus brief, meaning that he read it and taking it into the decision making process.

So, about the TON/SEC case. The judge asked the parties whether they would agree to prolong the injunction (it expired formally) until his decision and Skadden after huddling said “yes”, meaning that they smell victory.
