I think her honour was trying to point out that being 39 minutes late didn't warrant an overnight stay in jail, considering the court regularly hears people failing to report for days or weeks on end.
Again, it's not the time, it could be 12pm or 8pm, the point is if someone is 39 minutes late to report do they need to spend a night in jail and go through new motions in court?
