I'd say it stays down bc vol + weight stays the same, no matter where the sand is. But - why is it at the top at the beginning?

This answer is impossible because the hourglass starts at the top in the beginning and the water container is undisturbed at the beginning.

Thinking with the sand on top the timer is pinned by torque initially.

Initially pinned by friction induced by torque. After some sand falls the and releases the torque enough so that the buoyancy wins.
