This is a good first step effort, but a lot of vague language being used. For instance, who gets to make the decision of when "... the overall likely benefits substantially exceed the foreseeable risks and downsides."?

Does the amount of people impacted make a difference? If so, what are the limits? What about when you take into account race, social class, or any other categorical/numerical identifying features? Are these case-by-case decisions as well?
