Dreeben said clarifications of Mueller's jurisdiction were the result of "ongoing discussions" and interaction with the acting AG. U'd think if there was paper he'd say so, but maybe they feel it's all deliberative. I mean there must be drafts of the August memo, no?

There'd be Urgent memos to Rosenstein covering any major events, so definitely including the two searches.

What's most interesting is there might be a later version of the Rosenstein memo that authorizes investigation of the election-year mortgage fraud, but that would also include a broad range of other things (and so would include scary long redactions). No one asked for that.

Dreeben suggested today that was covered by the Ukraine bullet because the bank fraud was a way to extract money from the assets he purchased with ill-gotten Ukraine funds.

Manafort's lawyers actually said there was an additional bullet. So it's unclear.

It was just a possibility until the mention of the additional bullet that may be apocryphal. Now I'm going to have to see where I got that from.

Ellis is being a judge. We pay them to push lawyers around and should be grateful when they do, especially when prosecutors are the target. Likely worst outcome is EDVA prosecutes this on their own, which wouldn't do much damage to Mueller's case, unless DC got moved to EDVA

Seems pretty obvious to me that the judge is zeroing in on the discrepancy between Cohen and Manafort, the former isn't being prosecuted by Mueller et al. But the difference is that the crimes committed with Manafort (by tRUmp) happened during the election, not before.

Also that Manafort's alleged crimes involve Russia and Cohen's involve hush payments to American sex workers.

I can't see the DOJ losing this. It would change the way crimes are prosecuted. The conspiracy minded might think the judge is just pulling a nunez
