Yup. But also there is (and should be) different standards for dismissal versus being put in jail. So it may be the case that he should have been dismissed but not jailed, or neither, or both, depending on the facts.

The prison, not jail, question will come down to materiality, IMO. But Horowitz has provided abundant evidence his lies -- and they were lies and more -- obstructed the investigation.

McCabe was not the only, or even the original, source for that WSJ story. It seems plausible that some would-be prosecution witnesses against McCabe—especially from NY field office—probably had a strong incentive to throw McCabe under the bus to hide their own leak participation.

You're right; I didn't read the entire thing. But I was referring specifically to the fact that NY-ADIC gave some damaging statements, not all of which seem to correspond 1:1 with his contemporaneous notes, and McCabe believed that office responsible for the initial leaks.

Except that's completely unrelated to the charged conduct. Indeed, he got away with not copping to bawling NY-ADIC out by saying he didn't recall doing so. The key witnesses here are basically FBI Investigative Agents.
