Legal Twitter question: Could the Seth Rich folks suing Hannity/Fox demand they get access to any Hannity-Cohen comms pertaining to the former's conspiracy theorizing?

They could certainly demand it during discovery. The issue ultimately revolves around whether Cohen was serving in the capacity as Hannity's attorney. If not, then it is discoverable. Otherwise, it would likely be considered a privileged communication.

Even in the absence of privilege, careful drafting would be needed to avoid accusations of a fishing expedition. But, on the question of intent or reckless disregard of the truth, might work as reasonably calculated to lead to the discovery of admissible evidence.

It's just all so incestuous... Trump/Cohen –– Cohen/Hannity –– Butowsky/(and Hannity?) at the WH. I believe the suit accuses Butowsky and the WH working together on the Seth Rich conspiracy. Good luck to all involved because it's a tangled mess.
