It’s interesting to read and listen to so much criminal procedure commentary by people who have zero experience with the actual mechanics of an FBI raid or the mechanics of dealing with it in court. It’s not something you find in the casebooks. A lot goes on in the background.

And if I was on Cohen's team, I'd be screaming bloody murder about all the leaks out of SDNY about the case, and argue that's precisely why you can't trust DOJ's taint teams because all you have to do is pick up the NY
@nytimes to see DOJ leaking like a sieve.1 reply 1 retweet 0 likesShow this thread -
On the other hand what works for 69 year old manafort may not be the prudent dance for 40 something cohen. At times screaming to the crowd feels good for the moment but at days end makes the quiet walk more difficult.

Cohen has no media strategy, and that's a mistake. SDNY does. And Cohen shouldn't allow SDNY to preach the virtues of its noble taint teams while it leaks mad left and right. Morning Stan!

Some times the best media strategy in such cases is avoiding a pissing contest. BTW what have you learned about the subject matter of the taint team's reach? Morning Tor.

Agreed. But my concern is that the SDNY is already peeing on the defense with their selective leaks, and that's setting the narrative. Once that happens it's hard to change. Plus the hypocrisy of the SDNY's piety about their virtue while they selectively leak details is grating.

Not sure the leaks are from SDNY. Avanatti has access to much, if not all, of the information coming out (tho I admit SDNY is the top selling sieve on Amazon).

Not the warrant affidavits unless I’m mistaken.

Nope. But as noted here, the Cohen brief lists a bunch of what got seized. No reason Avanatti would have seen that, though.https://twitter.com/emptywheel/status/985542332257918976 …
