If they grant immunity Libby won't be going to jail. But Bush had already established that he wouldn't go to jail. The prosecutor has almost no leverage left to lose. We half agree - my claim is that the prosecutor loses almost all their leverage once jail is commuted. If Bush specifically pardons the obstruction/perjury that led to conviction, Libby takes Fifth in fear of Espionage Act. Still no leverage. A blank-check pardon exposes Bush.
Unless I am lost we are arguing about whether, with jail time commuted, Fitzgerald could have induced Libby to testify truthfully by dangling a restoration of his law license and a waiver of the fine. Not much bait, IMHO.
