"Determine" what? I think he's talking about those terms that *everybody* who uses fb has to scroll through and click "ok" at the bottom. But yes, he is correct - most people do not read these things. "... and sign the soul of my firstborn to Zuckerb..." - looks legit... click.

of course they know. FB (and may websites) track how long you've spent on a particular page, where your cursor was, how far you scrolled down, how fast you scrolled down etc. all of this could be used to determine whether you read a ToS
