      I agree. A TOS breach = leadership accepted a foreseeable risk. A security breach may or may not mean that. @emptywheel @CathyGellis

      Agree that TOS wasn’t the way to do it - esp on a publicly accessible social platform - but seems overbroad brush to generalize to contracting not being a useful for data rights/use-based protections.

      But this is why I keep thinking it's a GDPR compliance issue, because everyone's amending their TOS to be able to exercise downstream control over the PII they had collected (I think? It seems like something Europe wants to see.) But that creates a GDPR/CFAA collision too.

      I think I'm falling behind on the legal question (aside from I know that the law, even before GDPR, exposes CA and FB in their relevant jurisdictions in Europe).

          My CFAA point is a side show and prob only interesting to a subset of nerds. For the FB/CA story you are right to focus on EU/UK data protection claims, I think.
