Sure, but given that both CA and FB are facing challenges under EU law, the TOS language is actually far more useful.

As Cathy notes, EU law (actually even just UK law) will provide affected users a great deal of leverage over FB and CA. Breach is an American word that brings meaningless protections. Harvest and sale, or whatever you want to call it, brings far more in Europe.

And there are legal challenges in the works in both UK (v CA) and Ireland (v FB) on those grounds.

Agree. And stuff grandfathered in by FTC consent decree here is still fair game, and under stronger laws, there.

I'm having a hard time not seeing Facebook's move as a GDPR compliance exercise. I have all the feelings about that... but it would explain the TOS enforcement push.
