Having slept on the Grassley letter: as this unfolds it looks like we’re drifting away from claims that support FBI having done something inexplicably shady in this case, more toward claims that should lead us to ask whether the FISC’s bar is generally high enough for US persons.

You don't often go wrong by assuming that "look at this outrageous abuse of the system" stories are actually "look how we just noticed an instance of how the system operates all the time without comment" stories.

Somehow I'm the only genius civil liberties person who keeps saying, "Yaknow, if you think Steele is bad, look at the consultants they use against terrorism defendants. Or look at algos consultants using to predict recidivism." But that seems to be the appropriate answer.

I'm right there with you. Just sent a reporter to studies on informant abuse, incentives, etc. This "govt intentions beyond reproach" framing is disappointing.
