Uh...Bush/Cheney refused to obey FISA and two people -- then-FBI Director Robert Mueller and Deputy Attorney General James Comey -- refused to sign off on the their program (with a stand-off over a drugged out AG), meaning that the FBI/DOJ never participated in that. 2/ The highlighted passage here is a complete falsehoods. The GOP hated FISA from the start. They objected to its enactment. And then - as the NYT **won a Pulitzer for exposing** - Bush/Cheney refused to obey FISA when spying on Americans because they said it was too cumbersome. pic.twitter.com/HxVx7Kceee

This is wrong. DOJ signed off on warrantless wiretapping. The program was predicated on OLC memos. Comey rebelled against one component of the President's Surveillance Program--but not against warrantless wiretapping. Jack Goldsmith and Comey believed that the TSP fell into grey areas not covered by FISA. The program DOJ signed off on was one that was legally compliant, in their opinion. You can disagree with that, but it's not correct to say they went along w admin "refusing to obey" FISA.

My original point was that Comey and Goldsmith **approved** the warrantless eavesdropping program that the NYT exposed Bush & Cheney as having implemented. You denied this, claiming they stopped it, because you obviously didn't know any of this. Why not just admit that?

Glenn, the very article you cite notes that as soon as Goldsmith and Comey came on board, they identified the legal issues w Bush's original program. They forced the admin to make changes consistent with FISA. They did not authorize anything that was not legally justified.

You can screenshot specific pieces of the articles, just like you take my one phrase out of context of the whole piece. I've been warned that you attack and harass people who disagree with you and never let things go, which has me freaked out, so I won't engage with you further.

I wasn't requesting your engagement. But given that numerous others are pointing out your same factual errors- including @emptywheel & former ACLU Deputy Legal Director @JameelJaffer - that dodge won't be of much help to you.

Stuff like this drives me crazy, even though I know it shouldn't. She just published a NYT op-ed, then posted multiple tweets about it, filled not with bad opinions but with easily demonstrated factual falsehoods, but she knows it doesn't matter & doesn't need to address it.

I laugh that because I do really detailed rebuttals of people they mute me. There is a public record, I know it as well as anyone (and far better than Asha), and the response to to mute rather than adjust opinions to match the public record.

Yeah - the whole thing with Comey/Ashcroft/Card, etc was 14 years ago. Not shameful to be cloudy on the details. I wrote a book about it & wrote about it every day for years and it seems distant to me, too. Why can't she just say: yeah, I got that wrong? Remembered it wrong, etc?
