Not that I'm disagreeing, but while I've appreciated a lot of the expert legal commentary on this, much of it seems to miss this is not about the law, and certainly not about the facts. It's about what people can be convinced of.

I’m very familiar with Judge Hughes, have practiced in his court, and remember that case. Hughes very much says what he means and is a proponent of clearer legal writing.
