sure. argument could go: This memo shows the entire investigation is poisoned, and either Mueller and Rosenstein knew, should've known, or else they will act today or they're gone.

Especially since Mueller has rather conspicuously avoided doing anything that could be poisoned fruit, even in Manafort case.
