Why I’ve never understood the theory that we need a recused Sessions to stay at DOJ to protect Mueller. A weakened, groveling Sessions is the most dangerous option of all.https://twitter.com/brianbeutler/status/955628302852591616 …

I think that would be a good and winnable confirmation fight
-
If Trump’s goal was to mess with Mueller he wouldn’t nominate anyone but would slide an acting AG into place like Pruitt who could stay at least 270 days per Vacancies Reform Act.
-
I could make a good argument that Pruitt would have to recuse from the Russia investigation...
-
I think a strong argument can be made that, under the unique circumstances of the Russia investigation, any AG appointed by Trump would have a disabling conflict that requires recusal under 28 CFR 45.2 (a)(2), if not (1).
-
Maybe so, but Pruitt would never recuse.
-
Probably not. Although, the pushback from Mueller, the entire special counsel team and DOJ would be massive. I hesitate to predict how it it would play out, but I don't see Pruitt ever, in fact, "supervising" that investigation.

Pruitt wouldn't even need confirmation for I think 90 days.
